Sling Media Answers Forum Use Terms and Conditions

These Sling Media Answers Forum Terms and Conditions (these “Terms and Conditions”) govern your access to and use of the Sling Media Answers Forum web pages (the "Answers Forum"), any information, text, graphics, or other materials appearing in the Answers Forum (the "Content"). Your access to and use of the Answers Forum and/or the Content are expressly conditioned on your compliance with these Terms and Conditions. By accessing or using the Answers Forum or the Content, you agree to be bound by these Terms and Conditions.

Modification of Terms of Use

You acknowledge and agree that Sling Media may revise these Terms and Conditions from time to time. By continuing to access or use the Answers Forum or the Content after Sling Media makes any such revision, you agree to be bound by the revised Terms and Conditions.

General

The Answers Forum is made available to you only for your personal and non-commercial use. You may not use the Answers Forum for any commercial or promotional purpose.
Sling Media makes no guarantee regarding, and assumes no liability for, the security and integrity of any data or information that any user stores or transmits via the Answers Forum or the hosting services used for the Answers Forum, including, without limitation, any data or information stored or transmitted by any computer designated as "secure."
In addition to these Terms and Conditions, all use of the Answers Forum is governed by the Slingbox.com Terms of Use (http://www.slingbox.com/get/terms-of-use), the terms of which are incorporated herein by reference.
In the event of any conflict between these Terms and Conditions and the Slingbox.com Terms of Use, the terms of these Terms and Conditions will govern.
The Answers Forum is provided by Sling Media as a place for users of Sling Media products and technologies (“Sling Media Products”) to share information about the use and operation of such products. Sling Media is merely acting as a passive conduit for information and accepts no responsibility for and makes no representation or warranty with respect to the screening or verification of any information in the Answers Forum or for the accuracy, timeliness, efficacy or veracity of such information. Views expressed on the Answers Forum are not endorsed by Sling Media. Sling Media and its personnel will not be liable or responsible for any loss or damage suffered by you through your reliance on or use of any information obtained from the Answers Forum.
Sling Media does not prescreen information submitted by users of the Answers Forum (“Submissions”). Sling Media retains the right, but not the responsibility, to edit or remove any Submission, including, without limitation, those deemed by Sling Media to violate these Terms and Conditions. Sling Media (a) makes no warranty to you that it will edit, remove, or continue to permit the display of any specific Submission, whether or not subject to allegations that such Submissions violate these terms and conditiosn, and (b) will have no liability whatsoever for editing, removing, or continuing to permit the display of any Submission whatsoever. SUBMISSIONS ARE MADE AVAILABLE TO YOU ON THE ANSWERS FORUM “AS-IS,” WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND.
Sling Media involvement. Sling Media does not formally provide technical support on the Answers Forum. HOWEVER, INFORMATION THAT IS PROVIDED BY SLING MEDIA OR SLING MEDIA EMPLOYEES, IF ANY, IS OFFERED ON AN “AS IS” BASIS WITHOUT ANY REPRESENTATIONS OR WARRABNTIES OF ANY KIND.
To submit information to the Answers Forum, each user must have a unique user name and password combination, known as a Sling Account. Please review Sling Media’s Privacy Policy (http://www.slingbox.com/get/privacy), which describes how Sling Media collects, uses and protects your personal information. Sling Media cannot and will not be responsible for any problems or liability that may arise if you do not provide accurate, truthful and complete information.
Sling Media will cooperate with appropriate law enforcement and other governmental agencies and other parties involved in investigating claims of illegal or inappropriate activity, and shall have no liability to any user or any third party for any actions taken in connection with such cooperation. You agree to provide reasonable assistance in any such investigation.

Submissions

Stay on topic. Sling Media Answers Forums is made available to provide a forum for users of Sling Media Products to share information to help others use Sling Media Products more effectively. Unless otherwise noted, do not add Submissions about topics other than effective use of Sling Media Products, including, without limitation:

speculations or rumors about unannounced products.
discussions of Sling Media policies or procedures or speculation on Sling Media decisions.

Be polite. Everyone should feel comfortable reading Submissions and participating in discussions. Sling Media will not tolerate flames or other inappropriate statements, material, or links. Most often, a "flame" is simply a statement that is taunting and thus arbitrarily inflammatory. However, this also includes, without limitation, those which are libelous, defamatory, indecent, harmful, harassing, intimidating, threatening, hateful, objectionable, discriminatory, abusive, vulgar, obscene, pornographic, sexually explicit, or offensive in a sexual, racial, cultural, or ethnic context.
Post constructive comments and questions. Unless otherwise noted, your Submission should either be a technical support question or a technical support answer. Constructive feedback about product features is welcome as well. If your Submission contains the phrase “I’m sorry for the rant, but…” you are likely in violation of this policy.
No polls. Do not post polls or petitions or links to same.
Test your answer. When possible, make sure your Submission works on your own computer before you post it.
No advertising. Do not use the Answers Forum to sell or market your products to others and do not post a URL unless it directly answers a user’s question. If any portion of your Submission, including, without limitation, any posted URL, results in any accrual of compensation or benefit to you, you must note this in your post by stating, “I may receive some form of compensation, financial or otherwise, from my recommendation or link.” Without limitation, the following are some examples of uses that would violate this policy:

A Submission created solely to advertise a book, service, software or some other item for sale.
Any reference, including, without limitation, a link, to a commercial item that is not directly related to a relevant technical support question or answer. For example: “This post created by Super Post Creator.”
You may sign your Submissions with information about yourself. However, this should not include a link to a website.

No inappropriate user names or impersonations. Do not use inappropriate or offensive user names or aliases. Do not use user names that attempt to impersonate another user. User names may not contain website, email addresses or other contact information.
Keep within the law.

No material may be submitted that violates or promotes or encourages the violation of any local, state, foreign or international statute, regulation, rule, order, treaty or other law (each a “Law”).
Do not submit software or descriptions of processes that break or otherwise ‘work around’ digital rights management software or hardware.
Do not post defamatory material.

Submit your own work. Material submitted must be your own work or work to which you have a license.
License to use Submission. By sending a Submission to the Answers Forum you agree to grant Sling Media a perpetual, royalty-free, non-exclusive worldwide right and license, sublicensable through multiple tiers, to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, commercialize in any manner and exercise all copyright and publicity rights with respect to the Submission. If you do not want to grant to Sling Media the rights set out above, do not send your Submission to the Answers Forum.
By submitting a Submission, you represent and warrant that:

you are at least 18 years old;
you own all rights in your Submission, or, alternatively, you have acquired all necessary rights in your Submission to enable you to use your Submission as permitted herein and grant to Sling Media all rights in your Submission described herein;
your Submissions do not infringe the copyright, trademark, patent, trade secret or other intellectual property rights, privacy rights or any other legal or moral rights on any third party;
you voluntarily agree to waive all “moral rights” that you may have in your Submission;
any information contained in your submission is not known to you to be false, inaccurate or misleading;
your Submission does not violate any Law;
your Submission is not, and may not reasonably be considered to be, defamatory, libelous, hateful, racially, ethnically, religiously or otherwise biased or offensive, unlawfully threatening, unlawfully harassing, vulgar, pornographic, obscene or invasive of another’s privacy;
you were not compensated or granted any consideration by any third party for submitting your Submission;
your Submission does not contain any viruses, worms, Trojan horses, spyware or other potentially damaging programs or files;
your Submission does not contain information that you consider confidential, proprietary or personal; and
your Submission does not contain or constitute any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.

Minors

You must be at least 18 years old to post to the Answers Forum.
Never reveal any personal information.

Interference with the Answers Forum

You agree to not interfere with or disrupt the Answers Forum.
The Answers Forum may not be used to violate system or network security; such behavior may result in criminal or civil liability. Do not use the Answers Forum to engage, without limitation, in the following activities:

Gaining unauthorized access to, or attempting to compromise the normal functioning, operation or security of any network, system, computing facility, equipment, data or information.
Engaging in any activities that intentionally interfere with the ability of others to access or use the Answers Forum, any services provided therein or the Internet (i.e., Denial of Service attacks).
Monitoring any data, information or communications on any network or system not owned by user without authorization.
Gaining unauthorized access to the user accounts or passwords of other users of any system.
Attempting to intercept, redirect or otherwise interfere with communications intended for others.

You may not use the Answers Forum in a manner which purposely alters or forges any user’s identity. Users may not use The Answers Forum to engage, without limitation, in the following activities:

Sending any message or transmitting any electronic communication using a name or address other than user’s own for purposes of deception.
Impersonating someone else by altering user’s source IP address or by using forged headers or other identity information.

Sling Media may provide a system whereby users acquire points for various activities.

Do not ‘game’ the system. You agree to not create multiple IDs or otherwise manipulate the points system.
Do not ask for points. If you feel the system is not clear to users, please provide feedback to Sling Media; do not instruct other users unless they ask.

The Answers Forum may not be used to distribute electronic mail in an improper or illegal manner. You may not use the Answers Forum to engage, without limitation, in the following activities:

Transmitting unsolicited mass or commercial e-mail (i.e., spamming) for any purpose.
Enlisting a third party to transmit unsolicited mass or commercial e-mail on the user’s behalf.
Collecting responses from unsolicited mass or commercial e-mail, or advertising any website or the user’s identity in such e-mail.
Transmitting a large amount of e-mail to a recipient with the intent to disable their system (i.e., mailbombing).
Using another party's electronic mail server to relay e-mail without express permission.
Any e-mail message containing informational or commercial content is considered unsolicited unless it is sent to a recipient who expressly requested receipt of such e-mail via an "opt-in" process. It is each user’s responsibility to prove that the recipient explicitly requested inclusion on an e-mail list by direct action, preferably with evidence of confirmation by the recipient (i.e. "double opt-in").

The Answers Forum may not be used to violate the guidelines or restrictions imposed by the charter of any internet newsgroup. You may not use the Answers Forum to engage, without limitation, in the following activities:

Posting any commercial message or advertisement, unless permitted by the charter of the newsgroup.
Cross-posting a message to unrelated newsgroups or to any newsgroups where the post does not meet that newsgroup's charter.
Repetitious posting of off-topic or disruptive messages, unless specifically invited by the charter of the newsgroup.

Breach of the Terms and Conditions

If you fail to abide by these terms Sling Media may remove any or all submissions you have made to the Answers Forum. Sling Media may also send an e-mail that informs you that your Submission has been deleted or edited. Repeated inappropriate Submissions may result in your relevant account or accounts being placed into temporary or permanent suspension of your ability to participate in any or all of the areas on the Answers Forum.
If you post or send offensive or inappropriate content anywhere on or to the Answers Forum or otherwise engage in any disruptive behavior which Sling Media considers to be serious and/or repeated, Sling Media may use all available information about you to stop any further infringements. This may include, without limitation, informing relevant third parties such as your Internet service provider or law enforcement authorities of the infringement.
Sling Media reserves the right to delete any Submission, or take action against any account, at any time, for any reason.

Sling Media reserves the right to modify or terminate the Answers Forum or any service therein for any reason, without notice or liability to you.
Sling Media makes no representation that the Answers Forum is appropriate or available for use outside the United States. Access to the Answers forum from locations where such access is illegal or restricted is prohibited. You agree to comply with all Laws applicable to your use of the Answers Forum and any Submissions, including, without limitation, all export and re-export restrictions and regulations of the United States or any foreign agencies or authorities. In particular, but without limitation, no Submission may be exported or re-exported: (a) into any U.S. embargoed country or (b) to anyone on the on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Persons List or Entity List. By making or using any Submissions subject to any such regulations, you represent and warrant that you are not located in, under the control of or a national or resident of any such country or on any such list.
